NBFC को FIU-IND को क्या-क्या Report करना पड़ता है? CTR और PMLA Reporting समझें

Financial Intelligence Unit–India (FIU-IND) के reporting framework में किसी NBFC को केवल एक fixed number of “points” report नहीं करने होते। Applicable transactions और circumstances के आधार पर अलग-अलग prescribed reports relevant हो सकती हैं।

इनमें Cash Transaction Report (CTR) और Suspicious Transaction Report (STR) जैसे reporting requirements महत्वपूर्ण हैं। Reporting obligations Prevention of Money Laundering Act (PMLA) और उससे जुड़े applicable rules/framework के अंतर्गत देखे जाते हैं।

1. Cash Transaction Report (CTR)

आपके दिए source material के अनुसार, prescribed circumstances में ₹10 लाख से अधिक cash transaction CTR reporting के दायरे में आता है।

इसके अलावा, एक महीने के दौरान ऐसे integrally connected cash transactions जिनका aggregate prescribed threshold को पार करता है, वे भी reporting requirement के लिए relevant हो सकते हैं।

📅 Reporting Timeline:
आपके दिए sources के अनुसार CTR को संबंधित महीने के बाद अगले महीने की 15 तारीख तक submit करने की reporting requirement बताई गई है।
⚠ केवल ₹10 लाख से कम होने से transaction automatically clear नहीं होता

CTR threshold और suspicious-transaction reporting अलग concepts हैं। किसी transaction में suspicious pattern दिखाई देने पर STR requirements अलग से relevant हो सकती हैं, इसलिए केवल transaction amount देखकर compliance का निष्कर्ष नहीं निकाला जाना चाहिए।

Financial reporting framework का उद्देश्य unusual या prescribed financial transactions के records को उपलब्ध कराना और money laundering तथा अन्य financial risks की पहचान में financial intelligence system को सहायता देना है।

NBFC और USDT/Crypto Transaction में क्या जांच हो सकती है?

यदि किसी NBFC के नाम पर cash collection और बदले में USDT या अन्य Virtual Digital Asset (VDA) देने का allegation सामने आता है, तो transaction का source, KYC, company accounting, beneficial owner, exchange/wallet records और fund trail महत्वपूर्ण investigation points हो सकते हैं।
