NBFC FINnet 2.0 Compliance: FIU-IND, PMLA और RBI के नियम क्या हैं?

NBFC अगर FINnet 2.0 या FIU-IND Reporting Compliance पूरी न करे तो क्या होता है?

भारत में applicable NBFCs और अन्य Reporting Entities को Prevention of Money Laundering Act (PMLA), संबंधित Rules तथा regulatory directions के तहत AML/KYC और prescribed reporting requirements का पालन करना होता है।

जहां applicable हो, FINnet 2.0 registration तथा Suspicious Transaction Report (STR), Cash Transaction Report (CTR) और अन्य prescribed reports की filing compliance framework का महत्वपूर्ण हिस्सा हो सकती है।

1. FIU-IND की क्या भूमिका है?

Financial Intelligence Unit–India (FIU-IND) Reporting Entities से prescribed financial reports प्राप्त करता है और suspicious financial information का analysis करता है।

Registration या reporting में non-compliance सामने आने पर applicable PMLA framework के तहत FIU-IND clarification, compliance proceedings, directions या अन्य कार्रवाई कर सकता है।

किसी specific NBFC को “High Risk” या “Non-Compliant” घोषित किया गया है, ऐसा तभी कहा जाना चाहिए जब उसके लिए संबंधित authority का official order/list उपलब्ध हो।

2. RBI की Regulatory भूमिका

RBI-registered NBFCs पर Reserve Bank of India का regulatory और supervisory framework लागू होता है। AML/KYC compliance, governance और regulatory deficiencies RBI supervision के लिए महत्वपूर्ण विषय हो सकते हैं।

गंभीर या लगातार regulatory violations सामने आने पर RBI applicable law और regulatory powers के अनुसार directions, monetary penalty, restrictions या गंभीर मामलों में Certificate of Registration से संबंधित कार्रवाई कर सकता है।

3. Auditor, Compliance Officer और Internal Controls

NBFC की management, designated compliance function और applicable statutory/internal audit framework का उद्देश्य regulatory requirements और internal controls की समीक्षा करना भी होता है।

किसी material non-compliance के सामने आने पर उसका treatment applicable auditing standards, company law, RBI directions, PMLA requirements और facts पर निर्भर करेगा।

⚠ क्या Public भी Complaint कर सकती है?

हाँ। Regulatory monitoring मौजूद होने का अर्थ यह नहीं है कि investor, customer या अन्य व्यक्ति information/complaint नहीं दे सकता।

यदि किसी व्यक्ति के पास किसी NBFC से संबंधित suspicious fund movement, unexplained cash collection, KYC irregularity, fraud या अन्य documentary evidence है, तो matter के nature के अनुसार संबंधित competent authority को information दी जा सकती है।

NBFC से जुड़ी शिकायत कहां की जा सकती है?

RBI: RBI-regulated entity से संबंधित eligible customer-service grievances के लिए RBI Complaint Management System (CMS) उपलब्ध है।

FIU-IND: PMLA/AML और suspicious financial transaction से संबंधित information के लिए FIU-IND के official channels और current contact information देखें।

Police / Cyber Crime: Cheating, unauthorised transactions, cyber fraud या criminal fund trail के allegations होने पर Police/Cyber Crime authorities से संपर्क किया जा सकता है।

ED: Proceeds of crime और money-laundering का evidentiary basis सामने आने पर Enforcement Directorate की PMLA jurisdiction relevant हो सकती है।

महत्वपूर्ण:

FINnet 2.0 registration या FIU reporting में alleged non-compliance अपने-आप money laundering या fraud साबित नहीं करता। वास्तविक liability documents, applicable reporting obligations और competent authority की जांच/आदेश पर निर्भर करेगी।
