Omansh Enterprises Limited (अब Pipan Oils Limited, BSE Scrip Code: 538537) के NCLT/CIRP में जाने से पहले के कथित RTGS, billing और cash-collection trail की जांच की मांग के बीच CoC records भी महत्वपूर्ण सवाल खड़े करते हैं।
21 March 2023 की First CoC minutes में Raconteur Granite Limited की ओर से Rajiv Vashisht (Director) और Viva Enterprises की ओर से Vishal Abrol (Sole Proprietor) को present दिखाया गया है, जबकि “Suspended Director of Omansh Enterprises Limited (Now Pipan Oils Limited): None Present” दर्ज है।
इसी से जुड़े voting document में “Gaurav Kumar” नाम, handwritten designation और signature दिखाई देना जांच का विषय है। सवाल है—यदि यह signature Gaurav Kumar Abrol का है, तो उन्होंने Omansh Enterprises Limited (Now Pipan Oils Limited) की CIRP प्रक्रिया में किस creditor की ओर से, किस authorization और किस capacity में voting document sign किया?
एक अन्य voting sheet में Vishal Abrol के सामने handwritten designation “M.D. (Viva Enterprises)” जैसा दिखाई देता है, जबकि First CoC minutes में उन्हें “Sole Proprietor” बताया गया है। इस apparent discrepancy को original CIRP records, authorization documents और creditor records से verify किया जाना चाहिए।
सबसे बड़ा सवाल यह है कि Omansh Enterprises Limited (Now Pipan Oils Limited) के suspended directors CoC meeting में क्यों मौजूद नहीं थे? उन्हें notices किस residential/registered address, email और mobile number पर भेजे गए? Delivery/service proof क्या था? और RP/IRP को suspended management की ये contact details किसने उपलब्ध कराईं?
क्या इन घटनाओं का Omansh Enterprises Limited (Now Pipan Oils Limited) के pre-CIRP financial transactions से कोई संबंध था, या ये अलग-अलग घटनाएँ थीं? Gaurav Kumar Abrol, Rajiv Vashisht, Vishal Abrol, former management/promoters और RP/IRP की वास्तविक भूमिका तथा किसी alleged coordination का निष्कर्ष original notices, authorization letters, bank trail, CoC records और digital evidence की जांच के बाद ही निकाला जा सकता है।
Omansh Enterprises Limited का बाद में Pipan Oils Limited नाम होना अपने-आप पुराने CIRP allegations को साबित नहीं करता। हालांकि, Omansh Enterprises Limited (Now Pipan Oils Limited, BSE: 538537) के pre-CIRP से post-resolution तक corporate control, financial trail और ownership changes की जांच पूरी chronology को स्पष्ट कर सकती है।
