Omansh Enterprises Limited (now Pipan Oils Limited), BSE Code 538537 से जुड़े NCLT/CIRP proceedings, disputed loan claims और money trail को लेकर ABR NEWS स्वतंत्र जांच की मांग उठा रहा है।
⚖️ IBC Section 65 — Malicious or Fraudulent Initiation
Insolvency and Bankruptcy Code का Section 65 उस स्थिति से संबंधित है जहां insolvency resolution या liquidation proceeding fraudulently, malicious intent से या insolvency resolution के अलावा किसी अन्य उद्देश्य से initiate की गई हो।
क्या underlying creditor claims वास्तविक loan transactions पर आधारित थे? Loan agreement कहां है? Actual bank disbursement हुआ था? Board authorization क्या था? और CIRP claim किस evidence पर verify हुआ?
🚨 IBC में False Information, Concealment और Misconduct
IBC में insolvency process से जुड़े कुछ acts—जैसे निर्धारित परिस्थितियों में assets/property conceal करना, books/documents में falsification, material information छिपाना या false information देना—अलग-अलग criminal provisions के तहत consequences पैदा कर सकते हैं।
Sections 68–77 में अलग-अलग offences और अलग-अलग penalties हैं। इसलिए किसी particular व्यक्ति पर कौन-सा section और punishment लागू होगा, यह उसके alleged conduct और evidence पर निर्भर करेगा।

ABR NEWS को उपलब्ध complaints/material में Gaurav Kumar Abrol, Managing Director of Regency Fincorp Limited की alleged role को लेकर गंभीर आरोप और investigation questions उठाए गए हैं।
