ABR NEWS INVESTIGATION: Kolkata में Enforcement Directorate द्वारा Insolvency and Bankruptcy Code (IBC) के कथित misuse से जुड़े मामले में raids की खबर के बाद corporate insolvency proceedings में creditor claims, loan disbursement और connected parties की भूमिका एक बार फिर जांच के केंद्र में है।
IBC/NCLT Process में जांच का सबसे महत्वपूर्ण सवाल क्या है?
किसी insolvency proceeding में केवल creditor claim दिखाई देना अपने-आप यह साबित नहीं करता कि underlying loan वास्तविक था या fictitious। Investigation में यह देखना महत्वपूर्ण है कि loan agreement किसने execute किया, Board approval क्या था, actual bank disbursement हुआ या नहीं, claim किसने authorize किया और Resolution Professional के सामने कौन-से supporting records दिए गए।

इसी संदर्भ में ABR NEWS Omansh Enterprises Limited, now known as Pipan Oils Limited से जुड़े CIRP/NCLT records और disputed creditor claims की भी independent examination की मांग करता है।
ABR NEWS को उपलब्ध शिकायतों और material में आरोप लगाया गया है कि Omansh के insolvency proceedings में दिखाई गई कुछ loan liabilities और connected-party relationships की वास्तविकता की जांच आवश्यक है। विशेष रूप से सवाल यह है कि actual loan किसने दिया, किस bank account से disbursement हुआ और संबंधित Board members को transaction की जानकारी थी या नहीं।
Gaurav Kumar Abrol की भूमिका की जांच की मांग
ABR NEWS को उपलब्ध complaints और supporting material में Gaurav Kumar Abrol तथा संबंधित corporate entities की भूमिका को लेकर गंभीर आरोप लगाए गए हैं। ABR NEWS किसी आरोप को इस stage पर judicial finding के रूप में प्रस्तुत नहीं कर रहा है।

जांच में creditor-wise bank disbursement, loan agreements, Board resolutions, Form-C/claim documents, RP verification records, related-party relationships, GST/accounting entries, subsequent fund movement और ultimate beneficiaries की reconciliation महत्वपूर्ण होगी।
